Sentencia nº 38/2018 de ‘la manada’ como punto de inflexión en la tipificación de los delitos contra la libertad sexual en el código penal español. (RI §422451)  


Nº 38/2018 Judgment of 'the herd' as a turning point in the penalization against sexual freedom in the spanish penal code - Nani Aguilar Barriga

El presente estudio tiene como objetivo poner de manifiesto y denunciar la tremenda indefensión, injusticia y revictimización a la que se ven sometidas las mujeres víctimas de violencia sexual cuando acuden a una justicia en pleno siglo XXI sin formación en género; jueces y juezas movidos por estereotipos y roles de género llegan a calificar, unos hechos previamente descritos de violación en las sentencias, como abuso sexual. A continuación, el estudio se adentra en descifrar la legislación existente en España en torno a los “Delitos contra la libertad e indemnidad sexual”, regulados en los artículos 178 a 183 del Código Penal, donde no se contempla el consentimiento como requisito esencial para definir el delito de violación. Posteriormente, se analiza la Sentencia nº 38/2018, de 20 de marzo, de ‘la Manada’, que supone un punto de inflexión en la futura tipificación de los delitos contra la libertad sexual en el Código Penal español.

This study aims to highlight and denounce the terrible helplessness, injustice and victimization to which they are subjected women victims of sexual violence when they seek justice in the XXI century without gender training; judges driven by stereotypes and gender roles come to qualify previously described facts of violation in sentencing, as sexual abuse. Then, the study delves into deciphering the existing legislation in Spain about "Crimes against sexual freedom and integrity", regulated in Articles 178 to 183 of the Penal Code where consent as essential requirement is not envisaged to define the crime of rape. Subsequently, Sentence nº 38/2018, of March 20, of 'la Manada', which represents a point of inflection in the classification of crimes against sexual freedom in the Spanish Penal Code, is analyzed.
