El terrorismo yihadista ha afectado a la estructura política global. Ha generado una respuesta restrictiva de derechos y libertades justificada en la amenaza que supone el fenómeno. A nivel internacional se ha adoptado un enfoque más punitivo de las normas, lo que ha impuesto la necesidad de reformar la legislación interna. Sin embargo, en este proceso, el legislador se ha excedido en sus obligaciones y ha tipificado conductas que no estaban recogidas en el ámbito comunitario, utilizando la seguridad de los ciudadanos como argumento para ello.

Jihadist terrorism has affected the global political structure. It has generated a response that restricts rights and freedoms based on the threat posed by this issue. At the international level, a more punitive approach to standards has been adopted, imposing the need to update domestic legislation. However, in this process, the legislator has exceeded its obligations and has typified conduct that was not included at Community level, using the security of citizens as an argument for this.
