Derechos sociales y desarrollo: un abordaje del activismo judicial en la Corte Interamericana de Derechos Humanos. (RI §422421)  


Social rights and development: an approach to judicial activism in the Inter-american Court of Human Rights - Ana Claudia Santano

El estudio aborda la cuestión de la justiciabilidad de los derechos económicos, sociales y culturales en el ámbito de la Comisión y de la Corte Interamericana de Derechos Humanos y cómo esto puede ser analizado dentro del tema del activismo judicial. Para tanto, en un primer momento, se expone la normativa internacional referente a los derechos sociales, tanto en el sistema onusiano como en el interamericano. También se trata de la indivisibilidad e interdependencia de los derechos humanos, siendo rasgos que permiten visualizar que es necesario un equilibrio de la protección de estos derechos, conformando una unidad en su garantía. Luego, se examina con más detalle la actuación de la Comisión y de la Corte Interamericana en el sistema de monitoreo y de peticiones, para entonces traer la forma como la Corte está decidiendo casos involucrando los DESC y como la jurisprudencia fue evolucionando en los últimos años, a partir del análisis de algunos casos concretos. Al final, se hace una reflexión sobre si la actual posición de la Corte podría ser considerada como una forma de activismo judicial.

The paper raises the issue about the justiciability of economic, social and cultural rights within the framework of the Commission and the Inter-American Court of Human Rights and how this can be analyzed within the theme of judicial activism. In order to do so, in the first moment this paper exposes the international norms regarding social rights, both in the United Nations system and in the Inter-American system. The same is done about the indivisibility and interdependence of human rights, allowing us to see how a balance of the protection of these rights is necessary, forming a unit in its protection. A more detailed examination of the Commission's and the Inter-American Court's action in the monitoring and petition system will then be carried out, in order to bring to the fore the way in which the Court has decided cases involving ESCR and how the jurisprudence has evolved in recent years, from the presentation of some concrete cases. In the end, it is argued if the current position of the Court could be considered as a form of judicial activism.
