Recognition and evolution of the equality principle in the retirement pension of part-time workers - Ana N. Escribá Pérez

El presente artículo versa sobre la problemática de aplicación del principio constitucional de igualdad en las pensiones de jubilación de las personas trabajadoras a tiempo parcial. La jurisprudencia y la norma han debido, y deben, adaptarse a la normativa internacional, comunitaria y europea. El legislativo debe cumplir con las observaciones hechas por el Tribunal de Justicia de la Unión Europea ya que nuestro país estaba, hasta ahora, penalizando por duplicado el prestar servicios a tiempo parcial lo que, además, tenía repercusión, en mayor medida, en el colectivo de mujeres que son las que, tradicionalmente, prestan sus servicios de manera parcial, lo que influía en todas las prestaciones que debían recibir de la Seguridad Social pero, sobre todo, en la prestación por jubilación. A tenor de dos Sentencias importantes del Tribunal de Justicia de la Unión Europea parece que, cada día, estamos más cerca de solventar este tipo de injusticia.

This article addresses the problem to apply the constitutional principle of equality in the retirement pensions of part-time workers. The jurisprudence and the norm should have had, adapt to international, community and European regulations. Legislative powers must comply with the observations made by the Court of Justice of the European Union since our country was, until now, criminalizing in duplicate the provision of part-time services. The strongest impact falls upon the collective of women who are the ones that, traditionally, provide their services partially, this affected the full benefits they should receive from social security but, above all, the retirement one. According to two important Judgments of the Court of Justice of the European Union, it seems that, every day, we are closer to solve this kind of injustice.
