En el presente trabajo se analiza el contenido del derecho fundamental a la libertad ideológica, religiosa y de culto (con especial énfasis en la libertad religiosa), que consagra el artículo 16 de la Constitución española, así como el alcance de la limitación del orden público protegido por la ley; se estudia también, como cuestión distinta del derecho fundamental, la neutralidad religiosa el Estado. Todo ello, a la luz de la doctrina del Tribunal Constitucional. La posición institucional del Estado exigida por la Constitución vigente ha supuesto una modificación sustancial, que requiere un proceso de asimilación en el que las relaciones de cooperación del Estado con la Iglesia Católica y las demás confesiones deben tener un importante papel.

This work analyzes the content of the fundamental right to ideological, religious and worship freedom (with special emphasis on religious freedom), which is guaranteed by Article 16 of the Spanish Constitution, as well as the scope of the limitation of public order protected by law; the religious neutrality of the State is also studied as another matter different from the fundamental right. All this, following the doctrine of the Constitutional Court.
