Women´s autonomy at stake: surrogacy motherhood from a gender perspective - Octavio Salazar Benítez

La maternidad subrogada está generando en los últimos años un intenso debate político, jurídico y ético. Un debate que, al menos en su dimensión jurídica, se ha centrado en la protección del interés superior del menor, tal y como se refleja en la jurisprudencia del Tribunal Europeo de Derechos Humanos, y en el reconocimiento de un supuesto derecho a la paternidad/maternidad. Sin embargo, los derechos de las mujeres gestantes suelen situarse en un segundo plano. En estas páginas se analiza de qué manera la gestación subrogada incide en la autonomía de las mujeres y como, por tanto, es necesario analizarla desde una perspectiva de género.

The surrogacy motherhood is generating an intense political, legal and ethical debate in recent years. A debate which, at least in its legal dimension, has focused on the protection of the best interests of the child, as evidenced by the jurisprudence of the European Court of Human Rights, and in the recognition of a supposed right to paternity/maternity. However, the rights of pregnant mothers are ofthen placed in the background. This paper analyses how the surrogate gestation affects the autonomy of women and, then, how It needs to be analyzed from a gender perspective.
