Negociación colectiva y derechos digitales en el empleo público. (RI §422029)

La nueva Ley Orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales (LOPDGDD) adapta nuestro ordenamiento jurídico a las prescripciones del Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril, relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos, de obligado cumplimiento para los Estados miembros desde el pasado 25 de mayo de 2018. Pero incorpora además la regulación de lo que denomina “Garantías de los derechos digitales” (Título X) que, según expresa en su preámbulo, “encuentra su anclaje en el mandato impuesto por el apartado cuarto del artículo 18 de la Constitución Española y que, en algunos casos, ya han sido perfilados por la jurisprudencia ordinaria, constitucional y europea”. Varios de los preceptos de dicho Título X se dirigen novedosamente al “ámbito laboral”, para garantizar el derecho a la intimidad de trabajadores y empleados públicos en el uso de dispositivos digitales en el trabajo; frente al uso de dispositivos de videovigilancia y de grabación de sonidos en el lugar de trabajo; y ante la utilización de sistemas de geolocalización en el ámbito laboral. Garantías que la norma ubica en el ámbito del poder de control de los empleadores. Y como derecho propiamente digital, desde una perspectiva negativa, se reconoce por primera vez a nivel legal el derecho a la “desconexión digital en el ámbito laboral” de trabajadores y empleados públicos. Cierra el grupo de preceptos específicos del ámbito laboral el artículo 91 sobre “Derechos digitales en la negociación colectiva”, conforme al cual “Los convenios colectivos podrán establecer garantías adicionales de los derechos y libertades relacionados con el tratamiento de los datos personales de los trabajadores y la salvaguarda de derechos digitales en el ámbito laboral”. La presente aportación tiene como objetivo realizar una aproximación al significado, alcance y límites de esta remisión legal a la negociación colectiva respecto de los derechos digitales, en el ámbito del empleo público en particular. No se pretende analizar el contenido de cada uno de estos preceptos y los derechos y garantías legales que establecen, sino realizar una aproximación al papel que puede desarrollar la negociación colectiva en ese ámbito, teniendo en cuenta este marco legal, sus límites y las singularidades del empleo público en cuanto a tipos de personal y límites en la negociación colectiva. En suma, en qué medida podrá actuar la negociación colectiva para establecer garantías al derecho a la intimidad y otros derechos fundamentales de los empleados públicos ante la digitalización del control de su trabajo y el derecho a la desconexión digital.

The new Organic Law 3/2018, as of 5th of December, of Personal Data Protection and digital rights (LOPDGDD) adapts our legal system to the prescriptions of the Regulation (EU) 2016/679 of the European Parliament and of the Council, as of 27th of April, about the protection of natural persons regarding personal data processing and the data’s free movement, binding for Member States since last 25th of May, 2018. However, this law also adds the regulation of what it calls “Digital Rights Warranty” (Título 10) which, according to it’s preamble, finds its roots in the mandate imposed by paragraph 4 of article 18 in the Spanish Constitution and which, in some cases, has already been shaped by ordinary, Constitutional and European jurisprudence. Some of the precepts of said Título 10) are now newly focused on the “labour area”, in order to warrant the right to privacy of public workers and employees using digital devices at work against the use of video surveillance and audio recording devices at the workplace, as well as the use of geolocation devices on the labour area. The law places this warranty of the right to privacy in the scope of the control power of the employers. As a digital right, from a negative perspective, it is now for the first time legally acknowledged the right to “digital disconnection in the labour area” of the public workers and employees. The last of the specific precepts in the labour area is article 91 about “digital rights in collective bargaining”, according to which “collective agreements will be able to establish additional warranties of the rights and freedoms related to personal data processing of workers and to protect their digital rights in the labour area”. The main aim of this contribution is to carry out an understanding of the meaning, the reach and the limits of this legal remission regarding digital rights in the area of public employment in particular. It is not aimed to analyze the content of each of these precepts and rights and legal warranties, but to carry out an understanding of the role that the collective bargaining can play in this area, keeping in mind the legal framework, its limits and the singularities of public employment regarding the types of staff and the limits of the collective bargaining. To sum up, how will collective bargaining be able to take action in order to establish warranties of the right to privacy and other fundamental rights of public employees against the digitalization of the control of their work and the right to digital disconnection.
