La Orden Europea de investigación: reflexiones sobre su potencial efectividad a la vista de los motivos de denegación del reconocimiento y ejecución en España. (RI §421200)

Se analizan en este trabajo los motivos de no reconocimiento y no ejecución de la Orden Europea de Investigación, desde la perspectiva española como Estado de ejecución. Estamos en presencia de un instrumento de cooperación judicial transnacional de carácter híbrido, a medio camino entre la asistencia judicial convencional más avanzada y el reconocimiento mutuo de resoluciones judiciales. A falta de una previa y necesaria aproximación de las legislaciones nacionales en materia de investigación y prueba penal, seguramente el resultado alcanzado era el único posible en este momento.

This paper analyzes the grounds for non-recognition and non-execution laid down in the European Investigation Order, from the Spanish perspective when acting as executing State. We are in the presence of a hybrid instrument of cross-border judicial cooperation, which is halfway between the most advanced conventional mutual legal assistance and the mutual recognition of judicial decisions. In the absence of a previous and necessary approximation of national laws in the field of criminal investigation, gathering and admissibility of evidence, the result achieved was probably the only possible at this moment.
