Old and new interpretations of the article 99 of the Constitution - Guillermo de Lázaro Redruello

La crisis de 2016 ha dejado al descubierto notables deficiencias en la regulación constitucional de la investidura y ha puesto en entredicho muchas de las lecturas tradicionales del art. 99 CE, que presuponían un contexto político distinto al actual. Simultáneamente, han aparecido novedosas exégesis de dudosa constitucionalidad, que han generado una confusión doctrinal aún no resuelta sobre lo que el citado precepto impone, excluye o permite, y sobre la mejor forma de cumplir sus previsiones. Este trabajo pretende contribuir a clarificar esos extremos y a mitigar las disfuncionalidades que se puedan derivar de su aplicación en el nuevo escenario político.

The crisis of 2016 has exposed significant deficiencies in the constitutional regulation of the investiture, and has challenged many of the traditional readings of article 99 of the Spanish Constitution, interpretations that presupposed a political context different from the current one. Simultaneously, new exegeses of dubious constitutionality have appeared, which have generated a doctrinal confusion not yet resolved on what the aforementioned precept imposes, excludes or allows, and on the best way to comply with its provisions. This work aims to clarify these extremes and to mitigate the dysfunctions that may arise from its application in the new political scenario.
