The financial powers of the Spanish Parliament: from use to abuse in governmental veto on legislative initiatives with financial implications - Esperanza Gómez Corona

En la última legislatura hemos asistido a una conflictividad creciente con motivo del ejercicio del veto presupuestario por parte del Gobierno a las iniciativas legislativas con repercusiones financieras. Entre nosotros, el veto del gobierno se aplica en dos momentos distintos pero igualmente importantes: la tramitación parlamentaria del proyecto de ley de Presupuestos Generales del Estado y el ejercicio de la iniciativa legislativa con repercusión en el presupuesto en vigor. Su análisis ha arrojado consecuencias sorprendentes, como el veto de iniciativas con repercusiones financieras en ejercicios futuros, al margen de lo previsto en la Constitución Española y de la práctica parlamentaria asentada. Todo ello tiene importantes consecuencias para la posición respectiva del Gobierno y el Parlamento, alterando el sistema de checks and balances previsto en la Constitución.

During the last Legislature, there has been a growing unrest over the use of the veto by the government on budgetary aspects of legislative initiatives with financial implications. In Spain, governmental veto may be used in two different but equally important instances: during parliamentary processing of the General State budget draft bill; and in exercising legislative initiatives with an impact on the present budget. Its analysis has revealed surprising consequences, such as the government vetoing initiatives with financial implications in successive financial years regardless both Constitutional provisions and established parliamentary practice. All this has important consequences regarding the position of the Government vis-à-vis the Parliament, altering the system of checks and balances established in the Constitution.
