La Directiva de concesiones ha regulado de forma clara e incondicionada el régimen aplicable a la modificación de las concesiones, con el objetivo de introducir una mayor flexibilidad, ampliando las posibilidades de modificación. La LCSP, sin embargo, al regular las modificaciones no solo modula y matiza los conceptos comunitarios sino que, además, es mucho más restrictiva que la Directiva a la hora de permitir las modificaciones objetivas de las concesiones, lo cual no solo va más allá de las exigencias del Derecho europeo sino que, además, puede a traer consecuencias perjudiciales para el interés público.

The Directive of Concession Contracts has regulated in an unconditional and sufficiently precise way the modifications of a concession during its performance and the purpose of this aid measure is to introduce greater flexibility in the possible of modification without the need to carry out a new concession procedure. The Spanish Law is much more restrictive than the Directive in allowing the modification of a concession during its performance, which is not only a breach of Community law, but also, this restrictive nature will have harmful consequences for the public interest.
