The disciplinary responsibility of judges and magistrates in Spain and Italy - Fruela Río Santos

La responsabilidad disciplinaria judicial es el control de la actividad de los jueces y magistrados, institución jurídica existente en todo Estado de Derecho que beneficia a la sociedad y al Estado como garante del Poder Judicial. Los principios constitucionales hacen que las infracciones y sanciones estén predeterminadas por la ley, para que puedan imponerse a los jueces y magistrados, a través de un procedimiento justo y con todas las garantías procesales. Fuera de la esencia de la institución, los ordenamientos jurídicos español e italiano son mayoritariamente divergentes en las infracciones, sanciones y tramitación, a pesar de la existencia de ciertas similitudes en los órganos administrativos y judiciales que intervienen.

The judicial disciplinary responsibility is the control of the activity of judges and magistrates, legal institution existing in any Rule of Law that benefits society and the State as guarantor of the Judicial Power. The constitutional principles make that the infractions and sanctions are predetermined by the law, so that they can be imposed on the judges and magistrates, through a fair procedure and with all the procedural guarantees. Outside the essence of the institution, the Spanish and Italian legal systems are mostly divergent in infractions, sanctions and processing, despite the existence of certain similarities in the administrative and judicial bodies involved.
