Current features and trends in Latin American Federations - Vanessa Suelt Cock

Este artículo busca dar un panorama general de los casos de Estado federal en Latinoamérica concretamente los casos de México, Venezuela, Argentina y Brasil a partir de las características generales que la doctrina ha definido como rasgos mínimos de este tipo estatal. A través de estos elementos se busca comprender las circunstancias de contexto que dan lugar a la adopción del Estado federal en cada uno de estos países, y los rasgos generales que estos Estados federales presentan(1). La descripción de estos elementos permite concluir que el Estado Federal en Latinoamérica tuvo una relevancia histórica, que era proteger la autonomía de provincias que hoy son estados parte, pero su funcionamiento en la práctica no ha contado con suficientes elementos que proteja dicha autonomía, y por ello, se presentan rasgos que tienden a la centralización.

This article seeks to give a general overview of federal State types in Latin America, specifically the cases of Mexico, Venezuela, Argentina and Brazil, based on the general characteristics that the doctrine has defined as minimal features of this State type. Through this study, I seek to understand the circumstances of context that give rise to the adoption of the federal State in each of these countries, and the general features that these federal States present. The description of their elements allows me to conclude that the federal State in Latin America had a historical role, which was to protect the autonomy of former provinces that were then conformed as states, but its operation in practice has not put enough mechanisms to protect their autonomy. This has created features that tend towards centralization.
