El Tribunal Constitucional ha estimado el recurso de amparo interpuesto por los representantes de un discapacitado intelectual frente a una serie de resoluciones administrativas y judiciales contrarias al derecho a la igualdad que le impedían, por razón de la edad, el acceso a un centro residencial especializado. Por primera vez, la edad es analizada como factor de discriminación en el ámbito del acceso a los servicios sociales asistenciales para el colectivo de la discapacidad intelectual. El Tribunal Constitucional ampara al recurrente con un fallo rompedor pro igualdad salvando los potenciales condicionantes formales que podrían haber hecho fracasar el recurso de amparo.

The Constitutional Court has upheld the protection appeal filed by the representatives of an intellectually disabled person against a series of administrative and judicial resolutions contrary to the right to equality that prevented him, due to age, from accessing a specialized residential center. For the first time, age is analyzed as a factor of discrimination in the field of access to welfare social services for the intellectually disabled collective. The Constitutional Court protects the appellant with a groundbreaking ruling for equality, clearing the potential formal constraints that could have caused the protection appeal to fail.
