The exceptions to the principles of unity and jurisdictional exclusivity in the spanish Constitution - Isidro Fernández García

La configuración del Poder judicial diseñada por la Constitución Española de 1978 se fundamenta en la existencia de una organización o cuerpo único de jueces y magistrados a los que corresponde con carácter exclusivo el ejercicio de la función jurisdiccional. Estas características se unen a la inamovilidad, responsabilidad y sumisión exclusiva al imperio de la ley de dichos servidores públicos para asegurar así su independencia y, en definitiva, la existencia de un Estado de derecho. El presente trabajo pretende reflejar y analizar las excepciones al principio de unidad jurisdiccional contempladas por el texto constitucional así como los distintos supuestos discutidos que parecen cuestionar la reserva de jurisdicción de los jueces y tribunales españoles.

I. LOS PRINCIPIOS DE UNIDAD Y EXCLUSIVIDAD DE LA POTESTAD JURISDICCIONAL. II. EL MONOPOLIO ESTATAL DE LA JURISDICCIÓN. LOS SUPUESTOS DISCUTIDOS: 1. La autotutela de la Administración. 2. La jurisdicción del Tribunal Europeo de Derechos Humanos y del Tribunal de Justicia de la Unión Europea. 3. El reconocimiento y ejecución de resoluciones judiciales extranjeras y de los Tribunales eclesiásticos sobre matrimonio canónico. 4. Las resoluciones “procesales” de los letrados de la Administración de justicia y el principio de exclusividad de los jueces y tribunales. III. LAS EXCEPCIONES AL PRINCIPIO DE UNIDAD JURISDICCIONAL EXPRESAMENTE CONTEMPLADAS POR EL TEXTO CONSTITUCIONAL: 1. El Tribunal Constitucional. 2. El Tribunal de Cuentas. 3. La jurisdicción militar. 4. Los Tribunales consuetudinarios y tradicionales; el Tribunal del jurado; los jueces de paz y el arbitraje. IV. EPÍLOGO. V. RELACIÓN BIBLIOGRÁFICA.

The configuration of the judicial Power designed by the Spanish Constitution of 1978 is based on the existence of the organization of a unique body of judges and magistrates who is in charge on an exclusive basis of exercising the jurisdictional function. We have to add to these characteristics the irremovability, responsibility and exclusive submission to the empire of the law of the above mentioned public servants, thereby ensuring their independence and, consequently, the existence of a State governed by the principle of rule of law. This paper seeks to reflect and to analyze the exceptions to the principle of unity of jurisdiction contemplated by the constitutional text as well as the different controversial suppositions that seem to question the reservation of jurisdiction of the judges and the Spanish courts.
