Deferencia judicial hacia las agencias federales y deferencia hacia el legislador. La interpretación de la ley defectuosa y el principio democrático en la sentencia King v. Burwell. (RI §419700)  


Judicial deference towards federal agencies and towards the legislator. King v. Burwell and the interpretation of imperfect statutes and the democratic principle - Víctor Vázquez Alonso

El presente trabajo analiza la sentencia King v. Burwell. En esta sentencia, en primer lugar, la Corte Suprema desarrolla la idea de que la normal deferencia del juez hacia la regulación aprobada por las agencias no ha de extenderse a aquellos supuestos en los que se trata de una cuestión de especial importancia política y económica. En segundo lugar, la Corte también va a desarrollar una teoría de la interpretación de la ley, según la cual la interpretación textualista ha de ceder a favor de otra que tome en consideración "el plan del legislador", en aquellos supuestos en que la primera conduce a resultados absurdos. Desde la doctrina avanzada por la Corte, se intentará aquí reflexionar sobre la importancia que adquiere el principio de deferencia democrática hacia al legislador en aquellos supuestos en los que de ella depende la supervivencia de programas legislativos especialmente complejos y de importante valor democrático. Se atenderá igualmente a la evolución de la denominada Chevron Doctrine, y como la exclusión de su aplicación en las denominadas major quiestions abre la posibilidad para un papel más activo de los jueces en la construcción del derecho administrativo en los USA

The present work analyzes the sentence King v. Burwell. In this judgment, the Supreme Court first develops the idea that the normal deference of the judge to the regulation approved by the agencies should not be extended to those cases in which it is a matter of particular political and economic importance. Secondly, the Court will also develop a theory of the interpretation of the law, according to which the textual interpretation must yield in favour of another that takes into account "the plan of the legislator", in those cases in which the first leads to absurd results. From the doctrine advanced by the Court, we will try to reflect on the importance of the principle of democratic deference to the legislator in those cases where the survival of particularly complex legislative programs of important democratic value depends on it. It will also take into account the evolution of the so-called Chevron Doctrine, and as the exclusion of its application in so-called "major questions" opens the possibility for a more active role of judges in the construction of administrative law in the USA
