Historical evolution of anti-terrorist legislation in Spain: the fight against anarchist terrorism, subversive terrorism and jihadist terrorism - Manuel Cerrada Moreno

La legislación antiterrorista en España ha sido prolija y cambiante. Este trabajo tiene por objeto repasar su evolución histórica desde la primera legislación promulgada a finales del siglo XIX, enfocada a la lucha contra el terrorismo de signo anarquista, pasando por la legislación del régimen de Franco, la posterior a su muerte con la creación de la Audiencia Nacional y el tratamiento del terrorismo en el nuevo ordenamiento constitucional frente a la amenaza de ETA y las principales reformas del Código Penal de 1995, singularmente la llevada a cabo por la Ley Orgánica 5/2010, hasta llegar a la operada por la más reciente Ley Orgánica 2/2015, de 30 de marzo, de modificación del Código Penal en materia de terrorismo, aprobada para hacer frente al fenómeno del terrorismo yihadista. Finalmente, se señalará, a modo de conclusiones, cómo en las distintas legislaciones se aprecia la existencia en los delitos de terrorismo de un elemento objetivo o estructural y un elemento subjetivo, consistente en delinquir con una finalidad política subversiva.

The anti-terrorist legislation in Spain has been exhaustive and changing. This paper aims to review its historical evolution from the first legislation promulgated at the end of the XIX century, focused on the fight against anarchist terrorism, passing through the legislation of the Franco regime, the one after his death with the creation of the National Court (Audiencia Nacional) and the treatment of terrorism in the new constitutional system in the face of the ETA threat and the main reforms to the Penal Code in 1995, specifically the one carried out by Organic Law 5/2010, to reach the one operated by the most recent Organic Law 2/2015 of March 30th, amending the Criminal Code on terrorism, adopted to deal with the phenomenon of jihadist terrorism. Finally, as conclusions, it will be pointed out how in the different Spanish legislations terrorism offenses contain an objective or structural element and a subjective element, consisting in committing a crime with a subversive political purpose.
