España ratifica el Convenio Europeo sobre protección de animales de compañía, hecho en Estrasburgo el 13 de noviembre de 1987. (RI §419416)  


Spain ratifieds the European Convention for the protection of pet animals, done at Strasbourg, on 13 november 1987 - Anna Mulà Arribas

El Convenio del Consejo de Europa sobre protección de animales de compañía, hecho en Estrasburgo el 13 de noviembre de 1987, ha sido ratificado por España después de años de espera y de una extensa y dilatada tramitación y entrará en vigor el 1 de febrero de 2018. Actualmente, de los 47 Estados parte que integran el Consejo de Europa, 24 han ratificado dicho Convenio (también ha sido firmado por los Países Bajos). Este comentario parte del contexto histórico del Consejo de Europa como organismo responsable de la aprobación de cinco convenios de protección de animales, entre ellos, el presente, relativo a la protección de los animales de compañía. A continuación, examina brevemente el elenco normativo existente en España sobre animales de compañía y se profundiza en el texto y el contenido del Convenio Europeo. Finalmente, se analizan los efectos y el impacto inmediato del Convenio sobre dicho marco legislativo y se ahonda en las consecuencias y la trascendencia que la entrada en vigor de dicho instrumento convencional podría tener en un panorama que debiera ser compatible con el impulso que supone una nueva Ley marco estatal.

The European Convention for the Protection of Pet Animals, done at Strasbourg on 13 November 1987, has been ratified by Spain after years of delay and a long and extensive procedure. It will enter into force on 1 February 2018. Currently, 24 of the 47 member States of the Council of Europe have ratified the Convention (it has also been signed by the Netherlands). This note starts with a review of the historical context of the Council of Europe as responsible for the approval of five conventions on the protection of animals, including present one, on the protection of pet animals. The normative context of Spanish law on the protection of pet animals is briefly examined, and the text and content of the European Convention are further analysed. Finally, the effects and the immediate impact of the Convention on this legislative framework are studied, concluding with a more in-depth analysis of the consequences and the importance that the entry into force of this conventional instrument could have in an scenario that should be compatible with the need to foster the enactment of a new framework law of the Kingdom of Spain.
