Las fuentes literarias nos informan de que, en época arcaica, la mujer casada encontraba protección en las leges regiae ante determinados comportamientos del marido considerados como arbitrarios o contrarios a los mores maiorum. El hecho de que tales sucesos no estén confirmados en otras fuentes jurídicas escritas de tiempo posterior, unido a la inseguridad que presentan los relatos de historiadores clásicos, hace que nuestra tarea se centre en comparar las noticias de dichas fuentes literarias con el contexto social, político e histórico de aquellos primeros momentos del Derecho Romano.

The literary sources inform us that in the archaic period the married woman was protected by the leges regiae from certain behavior of the husband as arbitrary or contrary to the mores maiorum. The fact that such events are not confirmed in other later written legal sources, coupled with the insecurity that the stories presented by classical historians, makes us focus on comparing the events in these literary sources with the social, political and historical context of Roman law’s beginning.
