The new regional laws on social services: towards an increasing recognition of social services as vested rights -

Las prestaciones de servicios sociales en España, a diferencia de otras prestaciones como las de salud y de Seguridad Social, han tenido una eficacia jurídica limitada desde su implantación. La promulgación de Ley 39/2006, de 14 de diciembre, de Promoción de la Autonomía Personal y Atención a las personas en situación de dependencia, supuso una inversión de la tendencia, al calificar de derecho subjetivo determinadas prestaciones de atención a la dependencia. Desde entonces se han modificado doce Leyes autonómicas de servicios sociales, que incorporan prestaciones sociales garantizadas, exigibles ante las Administraciones Públicas e instancias jurisdiccionales. En este artículo analizamos cómo el desarrollo de estas nuevas leyes regionales está marcando una clara tendencia hacia el reconocimiento progresivo de los servicios sociales como derechos subjetivos.
The delivery of social services in Spain, unlike other public services such as health and social security, have yet had limited legal effectiveness. The passing of Law 39/2006, of December 14, on the Promotion of Personal Autonomy and Care for Dependent People, however, has been considered as a turning point in this regards, by including as vested rights certain social services such as dependent care assistance. Since then, twelve Laws have also been modified at the regional government level, incorporating the so-called guaranteed or essential social benefits, which may be enforced before administrative authorities and courts. In this paper, we analyze how the development of these new regional Laws is pushing towards an increasing recognition of social services as vested rights.
