La protección del derecho y obligación constitucional de motivación de las decisiones jurisdiccionales es una arista del derecho al debido proceso, configurada como garantía de los justiciables y un deber de los operadores judiciales en Perú y España. Existen diversos criterios jurisprudenciales en ambas regiones que delinean su contenido constitucional protegido y por consiguiente, los supuestos de su tutela en el seno del máximo Tribunal de lo Constitucional, los cuales serán objeto de comparación en el presente estudio.

The constitutional protection of the right and duty to motivation of judicial decisions is an edge of the right to due process, set as a guarantee to litigants and as a duty of the judicial authorities in Peru and Spain. There are several legal criteria in both regions delineating its constitutionally protected content and therefore cases of its judicial protection within the Constitutional Tribunal, which shall be compared in this study.
