The assault to the Parliament of Catalonia: a real confrontation of rights and a supposed confrontation of legitimacies - Alexandre H. Català i Bas

En el asalto al Parlament de Catalunya se dio un conflicto real entre los derechos de los manifestantes (libertad de expresión y derecho de manifestación) y los cargos representativos (derecho a la integridad, derechos de la personalidad y derecho a desempeñar el cargo). La Audiencia Nacional en su sentencia otorgó el status de representante de la sociedad a los manifestantes, lo que es más que dudoso. Sólo son representantes los elegidos en las urnas. Los manifestantes se representan a sí mismos por mucho que sus reivindicaciones sean compartidas por la mayoría de la ciudadanía.

The assault to the Parliament of Catalonia produced a conflict between the rights of the demonstrators (freedom of expression and right to protest) and the rights of the representatives (individual rights and the right to hold office). In its decision, the Audiencia Nacional granted the protesters the status of representatives of society, which is at least quite doubtful. And so, because only those who have been elected in an election deserve the title of representatives. The protesters represent exclusively themselves, even though their claims could be shared by most citizens.
