La Carta Social Europea en serio - Claudio Panzera

La Carta sociale europea (CSE), adottata dal Consiglio d’Europa nel 1961 e riveduta nel 1996, è solitamente considerata la “sorella povera” della Convenzione europea dei diritti dell’uomo (CEDU), soprattutto in ragione del più debole sistema di controllo in essa previsto. In realtà, spesso si dimentica che solo una visione integrata dei due testi convenzionali è in grado di riflettere fedelmente il principio di “indivisibilità” dei diritti fondamentali. In tal senso, la previsione nel Trattato di Lisbona dell’adesione dell’UE alla seconda, ma non anche alla prima, conferma la distanza ancora esistente sulla strada dell’integrazione europea fra libertà economiche e giustizia sociale, ed appare affetta dal medesimo “strabismo” costituzionale. Eppure, l’organo istituito per vigilare sul rispetto da parte degli Stati degli obblighi assunti con la ratifica della CSE (il Comitato europeo dei diritti sociali) è stato fra i più attivi a livello europeo nella tutela dei diritti c.d. sociali, rappresentando ancora oggi l’unica istanza europea specializzata in materia. Il presente contributo, attraverso un’illustrazione dei vantaggi offerti dal doppio sistema di controllo disposto dalla CSE e una comparazione fra le decisioni del Comitato e la giurisprudenza delle Corti europee in tre vicende altamente significative (le misure anticrisi imposte dalla Troika alla Grecia, il noto caso Laval e la protezione degli immigranti irregolari), intende offrire argomenti per una rivitalizzazione di tale strumento convenzionale nella prospettiva di una sempre maggiore “Costituzionalizzazione” dell’ordinamento UE.
La Carta Social Europea (CSE), adoptada por el Consejo de Europa en 1961 y revisada en 1996, se considera normalmente “la hermana pobre” del Convenio Europeo de Derechos Humanos (CEDH), sobre todo, porque el sistema de control previsto en ella es más débil. En efecto, con frecuencia se olvida que solamente una visión integrada por ambos textos convencionales puede reflejar fielmente el principio de “indivisibilidad” de los derechos fundamentales. En este sentido, la previsión en el Tratado de Lisboa de la adhesión de la UE a la segunda, pero no a la primera, confirma la distancia que aún existe en el camino de la integración europea entre libertad económica y justicia social, y parece afectada por el mismo “estrabismo” constitucional. Y sin embargo, el órgano establecido para vigilar el respeto, por parte de los estados, a las obligaciones asumidas con la ratificación de la Carta (el Comité Europeo de Derechos Sociales), ha sido uno de los más activos a nivel europeo en la tutela de los derechos sociales, representando hasta el día de hoy la única instancia europea especializada en materia. El presente estudio, a través de una ilustración de las ventajas ofrecidas por el doble sistema de control dispuesto por la CSE y una comparación entre la decisión del Comité y la jurisprudencia de las Cortes Europeas en tres casos altamente significativos (las medidas anticrisis impuestas por la Troika a Grecia, el conocido caso Laval y la protección de los emigrantes irregulares), quiere ofrecer argumentos para una revitalización de tal instrumento convencional en la prospectiva de una mayor “constitucionalización” del ordenamiento UE.

The European Social Charter (ESC), adopted by the Council of Europe in 1961 and revised in 1996, is usually considered the “poor step-sister” of the European Convention on Human Rights (ECHR), also because of the weaker control system provided therein. It is however unquestionable, though often disregarded, that only an integrated understanding of the two treaties may fully comply with the principle of the “indivisibility” of human rights. From this standpoint, EU accession to the ECHR (art. 6(2) TUE), but not even to the ESC, looks like an implicit restatement in the integration process of the existing divide between economic freedoms and social justice, reflecting a sort of “constitutional squint”. Yet, the ESC’s guardian – the European Committee of Social Rights – has been amongst the European bodies the most activist in protecting “social” rights over the past decades, standing nowadays as the only European (quasi-)judicial branch specialized in the matter. Through a description of the concrete advantages arising from the double control system pro-vided for in the ESC and by a comparison between the Committee’s decisions and the European Courts’ rulings on three hard cases (the austerity measures imposed to Greece by Troika, the Laval saga and the protection of unlawful immigrants), the paper aims at positively contributing with reasons and arguments to a relaunch of the Charter system, especially in a EU “constitutionalizing” perspective.
