Este trabajo tiene por objeto analizar la relación entre deporte, fútbol y ayudas de Estado a la luz del Derecho de la Unión Europea. El trabajo examina, en primer lugar, las razones por las que la Comisión Europea ha comenzado a aplicar las normas sobre ayudas estatales a los clubes de fútbol recientemente. En segundo lugar, el trabajo analiza la manera en que la Comisión Europea ha aplicado la definición de ayuda de Estado al ámbito del fútbol, y especialmente si de esta aplicación se deduce una flexibilización de los criterios del artículo 107.1 del Tratado de Funcionamiento de la Unión Europea en atención a la conocida como especificidad del deporte. En tercer lugar, el trabajo estudia la aplicabilidad de las normas sobre compatibilidad y recuperación de las ayudas estatales a la esfera del fútbol a la luz de la jurisprudencia de los tribunales europeos.

This work aims to analyze the relationship between sport, football and State aid under European Union law. The paper examines, firstly, the reasons that may explain why the European Commission has recently started to implement the rules on State aid to football clubs. Secondly, the paper analyzes the way in which the European Commission has applied the definition of State aid to the football field, and especially if the Commission has been flexible in the application of the criteria of Article 107.1 of the Treaty on the Functioning of the Union in light of the so-called specificity of sport. Thirdly, the paper examines the applicability of the rules on compatibility and recovery of State aid to the football field in light of the jurisprudence of the European Courts.
