Exploración del menor-víctima durante la fase de instrucción y su valor como prueba preconstituida en el acto del juicio oral: un examen a la luz de la reciente jurisprudencia del Tribunal Supremo. (RI §415914)  


Exploration of the child victim during the phase of instruction and his value as preconstituted evidence in the oral proceedings: a review in the light of the recent jurisprudence of the Supreme Court - Manuel José García Rodríguez

El presente trabajo tiene como objeto examinar los presupuestos y requisitos procesales exigidos por la reciente jurisprudencia del Tribunal Supremo y Constitucional, para otorgar validez como prueba de cargo preconstituida a las declaraciones prestadas durante la fase sumarial por los menores-víctimas en delitos de carácter sexual u otros especialmente violentos, para evitar que tengan que volver a declarar en el acto del juicio oral con el doble objetivo de minimizar el riesgo de su victimización secundaria y proteger la calidad de su testimonio como elemento de prueba en el curso del proceso. Y analizar los estándares mínimos establecidos por nuestros tribunales, de acuerdo con los pronunciamientos de la justicia europea, para salvaguardar que esa exploración judicial se desarrolla dentro de un marco adecuado y suficiente de posibilidades contradictorias, conciliando el derecho del menor a su especial protección y el del acusado a un proceso justo con todas las garantías.

The present work has as object examine the budgets and procedural requirements demanded by the recent jurisprudence of the Supreme and Constitutional Court, to grant validity in proof of post preconstituted to the declarations given during the summing phase by the children-victims in crimes of sexual character or specially violent others, to prevent them from having to return to declare forthwith of the oral judgment with the objective double of minimizing the risk of his secondary victimización and protecting the quality of his testimony as element of evidence in the course of the process. And to analyze the minimal standards established by our courts, in agreement with the pronouncements of the European justice, to safeguard that this judicial exploration develops inside a suitable and sufficient frame of contradictory possibilities, harmonizing the right of the child to his special protection and that of the defendant to a just process with all the guarantees.
