Desde su implantación, el contrato de apoyo a los emprendedores ha sido objeto de un riguroso escrutinio ante diversas sedes judiciales para constatar su adecuación al ordenamiento jurídico. Como parte de ese escrutinio, se elevó una cuestión prejudicial ante el Tribunal de Justicia de la Unión Europea para preguntar sobre la compatibilidad de dicho contrato con el artículo 30 CDFUE y con la Directiva sobre el trabajo de duración determinada. Sin embargo, en su reciente sentencia de 5 de febrero de 2015 el Tribunal de Justicia se ha declarado incompetente para responder a las preguntas planteadas. En el presente trabajo se examinan las causas de dicha decisión, y se reflexiona sobre el posible agotamiento de las vías judiciales para hacer frente al contrato de apoyo a los emprendedores.

Since its implementation, the contract to support entrepreneurs has undergone rigorous scrutiny before various judicial Courts to verify its compliance with the provisions of the legal system. As part of such scrutiny, a preliminary ruling was referred to the Court of Justice of the European Union to ask about the compatibility of the contract with Article 30 of the Charter of Fundamental Rights of the European Union and Council Directive 1999/70/EC of 28 June 1999 concerning the framework agreement on fixed-term work concluded by ETUC, UNICE and CEEP. However, the Court of Justice, in its recent judgment of 5 February 2015, has declared itself incompetent to respond to all of the questions referred. This paper examines the reasons for that decision and reflects on the possible depletion of the legal means to deal with the entrepreneurs support contract.
