Hermeneutic reading of the neoconstitutionalism’s characteristics - Lenio Luiz Streck

El término neoconstitucionalismo, acuñado por un grupo de constitucionalistas españoles e italianos, aunque haya representado un importante avance para la afirmación de la fuerza normativa de la Constitución en la Europa continental, en Brasil, no obstante, ha terminado por institucionalizar una recepción acrítica de la jurisprudencia de los valores, de la teoría de la argumentación de Robert Alexy y del activismo judicial norteamericano. Esa mala asimilación del neoconstitucionalismo ha dado origen a situaciones problemáticas en el derecho brasileño, ya que han contribuido a la corrupción del propio texto de la Constitución. De ese modo, con el fin de preservar la autonomía del Derecho y las conquistas democráticas de la segunda posguerra, es necesario, a partir de una perspectiva hermenéutica y comprender los malentendidos acerca de las principales características del neoconstitucionalismo.

The term neoconstitutionalism, coined by a group of spanish and italian constitutionalists, although it represented a major step toward the affirmation of the normative force of the Constitution in Continental Europe, in Brazil turned out to institutionalize uncritical reception of the jurisprudence of values, the argumentation theory of Robert Alexy and the American judicial activism. That bad assimilation of the neoconstitutionalism has caused problematic situations in the brazilian law, contributing for the corruption of the text of the Constitution. Thus, in order to preserve the autonomy of law and the democratic achievements of the second post-war, it is necessary to understand the misunderstandings about this issue and understand the main features of neoconstitutionalism.
