La riforma della filiazione alla luce della Legge del 10 dicembre 2012 N.219. (RI §415539)  


The reform of the filiation in the light of the Law of December 10th, 2012 N.219 - Rosaria Giampetraglia

Con la legge 10 dicembre 2012 n.219 recante “Disposizioni in materia di riconoscimento dei figli naturali” e che ha trovato attuazione con il dlg. 28 dicembre 2013 n. 154 è stata introdotta nell’ordinamento italiano una riforma epocale e radicale dei rapporti familiari. Con tale riforma si è affermato il principio dell’unicità dello status di figlio che ha lo scopo di eliminare ogni forma di discriminazione tra figli legittimi e figli naturali. Tutti i figli hanno gli stessi diritti e gli stessi doveri indipendentemente dal contesto della nascita, è importante il solo momento biologico. Il riconoscimento di tale principio, oltre ad evidenziare alcune criticità, porta alla separazione tra lo stato giuridico dei figli e quello dei genitori, all’instaurazione del rapporto di parentela naturale tra il figlio ed i parenti del genitore che lo ha riconosciuto e alle inevitabili ripercussioni in ambito successorio. La riforma ha il merito di aver stimolato ancora una volta il dibattito sulla necessità di eliminare ogni forma di discriminazione in tema di unioni di fatto.

With the law number 219 of the 10th of December of 2012 whose object is “dispositions concerning the recognition of natural sons” which has been adopted with the dlg. 154 of the 28th of December of 2013 an epochal and at the same time a radical reform of the familiar relationships has been introduced in the italian judicial system. With this reform it has been affirmed the principle of the uniqueness of the status of son whose aim is to delete every form of discrimination between legitimate sons and natural sons. All children have the same rights and the same duties independently from the context of the birth, only the biological moment is important. The recognition of such a principle, not only underlines some critical situations but it also brings to the separation of the juridical status of the children and the one of their parents. It also leads to the establishment of the natural relationship between son and parents who have just recognised the kid, plus it leads to the inevitable repercussions in the context of inheritance. The reform, once again, has the merit of having stimulated the debate on the necessity of deleting every form of discrimination regarding the de facto unions.
