Tras la ratificación por España de las históricas Enmiendas al Estatuto de Roma de la Corte Penal Internacional, se plantea la disyuntiva de si proceder a implementar su contenido en el Código Penal español, en particular en lo que concierne a la definición del crimen de agresión. Se trata de un delito complejo y muy politizado, para cuya definición han sido necesarias décadas de esfuerzos diplomáticos y académicos. Por ello, procede examinar los aspectos básicos de la formulación del delito tal y como fue aprobada en Kampala, para posteriormente valorar la oportunidad y modo de llevar a cabo su transposición, de forma respetuosa tanto al espíritu de las Enmiendas, como a los principios de nuestro sistema.

Following the Spanish ratification of the Amendments to the Rome Statute of the International Criminal Court, the question faced now is whether it is necessary to implement its content into the Spanish Criminal Code, in particular referring to the definition of the crime of aggression. It is a very complex and politicised crime and decades of diplomatic and academic efforts have been needed to define it. It is therefore necessary to examine the core elements of the crime as it was defined in Kampala, and to evaluate means and opportunity to carry out the aforementioned implementation, in a way that is both respectful to the spirit of the amendments, and to the principles of our system.
