The regulation of the factor of sustainability and of the index of revaluation of the system of pensions of the social security after coming into force the optional protocol to the convention of economical, social and cultural rights. - Edurne Terradillos Ormaetxea

Este trabajo se dirige al análisis transversal de dos hechos sincrónicos que han ocurrido en 2013: por un parte, la reciente entrada en vigor en España del Protocolo Facultativo del Pacto Internacional de Derechos Económicos, Sociales y Culturales que, como novedad más destacada, faculta a los ciudadanos, individual o colectivamente, a denunciar la vulneración de los derechos contenidos en el Pacto; y, por otro, la inminente aprobación del Proyecto de Ley reguladora del Factor de Sostenibilidad y del Índice de Revaloración del Sistema de Pensiones de la Seguridad Social. Los importantes cambios aparejados a la aprobación de la “penúltima” reforma del sistema público de pensiones español, y la adecuación con la doctrina del Tribunal Constitucional y con la interpretación del derecho a la seguridad social contenido en el Pacto, son cuestiones que van a ocupar buena parte de este trabajo.

This work focused on the combined analysis of two events that have happened in 2013: on one hand, the recent coming into force in Spain of the Optional Protocol to the Convention of Economical, Social and Cultural rights. It is remarkable that this Protocol allows individual or groups of citizens to denounce the violation of the rights protected by the Convention. On the other hand, the up-coming Law about the Factor of Sustainability and of the Index o Revaluation of the Spanish public pensions, which is going to introduce important changes of the calculation of pensions and of its revaluation. If this modification is in accordance with the Spanish Constitutional Court’s doctrine and with the interpretation of the right to social security contained in the Convention will entertain the next pages.
