Si bien la modificación del régimen de aportación a la prestación farmacéutica ambulatoria era necesaria, no es menos cierto que esta nueva regulación peca de oscura y no resultaría difícil tildarla de contraria a la seguridad jurídica. Y es que, a la hora de determinar los ingresos de los sujetos pasivos para establecer el porcentaje de aportación que les corresponde, no se tiene en cuenta la situación económica real de los mismos, sino que se prevé su aplicación en base a datos desfasados. Lo anterior obedece posiblemente a las excesivas prisas con las que se puso en marcha este nuevo mecanismo, para el que no estaban preparados ni los ciudadanos ni las propias Administraciones Públicas encargadas de aplicarlo. Y es que, ya lo dice el refrán “las cosas bien hechas, se hacen despacio”.

While changes to the percentage contribution to ambulatory pharmaceutical services was necessary, it is also true that this new regulation is guilty of dark and it is not difficult to tick it as against of legal certainty. In determining the taxable income for the percentage of contribution it deserves, it is not taken into account the real economic situation of the taxable persons and provides application based on outdated data. This is possibly due to excessive haste with which they launched this new mechanism, for which they were not prepared neither citizens, nor their own government responsible for implementing. And, as the saying goes "well done, is done slowly."
