La flexibilidad interna a través de la reformulación de la estructura de la negociación colectiva tras las sucesivas reformas laborales: del RDL. 7/2011 a la Ley 3/2012. (RI §413067)  


Internal flexibility in the light of the reformulation of the structure of collective bargaining after subsequent labour law reforms. Causes and effects. From spanish Decree Law 7/2011 to Act 3/2012 - Francisco Vila Tierno

En los últimos dos años, en un marco de modificaciones legislativas continuas en el ámbito laboral, se han producido importantes reformas que afectan a nuestro sistema de negociación colectiva. En esa línea, hemos querido identificar las tres vías de actuación esencial en esta transformación, que se corresponden, en primer lugar, con la definición de una nueva institución fruto de la suma de dos ya preexistentes: el descuelgue convencional (como suma de la modificación sustancial de condiciones de trabajo pactadas en convenio colectivo más el descuelgue salarial); en segundo lugar, las nuevas reglas de articulación y concurrencia de convenios colectivos; y, en tercer y último lugar, las previsiones relativas a la duración (y contenido) de los acuerdos. Todo ello se traduce en una flexibilización (como así se reconoce expresamente por el legislador) extraordinaria en la regulación de las condiciones de trabajo y empleo hasta el punto de hacer desaparecer, en determinados supuestos, los umbrales de protección que habían venido suponiendo los límites convencionales.

La flexibilización (casi) absoluta en la regulación de las condiciones de trabajo: el descuelgue convencional o el fin de la barrera infranqueable de lo establecido en la negociación estatutaria.- III. La articulación de convenios como mecanismo de flexibilización.- IV. La disminución del contenido mínimo o necesario del convenio y las medidas para evitar la petrificación de las condiciones de trabajo y empleo.-

In the preceding two years and with continuous legislative transformation framing the labour domain, important reforms on the Spanish system of collective bargaining have been passed. Thus, this work identifies the three fundamental forces guiding the above mentioned transformation. Firstly, the definition of a new institution resulting from two pre-existing ones: the conventional salary opt out (as the resulting element from the combination of the substantial modification of labour conditions plus the salary opt out clause); secondly, the new regulations on the articulation and concurrence of collective agreements; and, thirdly, the perspectives as to the duration (and content) of agreements. As the legislator openly admits, these three forces lead to an extraordinary flexibility regarding the regulation of labour conditions and employment, which eventually produces the abolition of thresholds of protection traditionally considered as conventional.

The near complete flexibilization as to the regulation of labour conditions: the salary opt out clause, or the end of the insuperable barrier within the domain of statutory bargaining.- III. The articulation of collective agreements as a flexibility oriented procedure.- IV. The reduction of minimal contents as to collective agreements and the actions aimed at preventing from the hardening of labour or employment conditions.
