How to manage financial crisis challenging european constitutional changes: judgment pringle - David Ordóñez Solís

La sentencia Pringle es un claro ejemplo de colaboración entre el Tribunal Supremo de Irlanda y el Tribunal de Justicia de la Unión Europea. En esta sentencia el Tribunal de Justicia ha examinado la validez de la reforma constitucional simplificada intentada respecto del artículo 136.3 TFUE y ha admitido la compatibilidad del Tratado que establece un Mecanismo Europeo de Estabilidad (MEDE) con el Derecho de la Unión Europea. La sentencia Pringle se dicta en el contexto de otras reformas con el fin de superar la crisis financiera en Europa y a tal efecto se alude en el estudio a las decisiones de 2012 del Tribunal Constitucional alemán y al Tratado de Estabilidad, Coordinación y Gobernanza en la Unión Económica y Monetaria (TECG o ‘Fiscal Compact’).

Judgment Pringle is a clear example of cooperation between the Supreme Court of Ireland and the European Court of Justice in the European Union (ECJ). In this decision, the ECJ has analysed the validity of the amendment, through the simplified revision procedure, of article 136.3 TFEU and it has accepted the compatibility between the Treaty establishing the European stability mechanism (ESM) and the EU Law. The Pringle Judgment is taken in a context of other reforms in order to challenge the financial crisis in Europe, especially decisions delivered in 2012 by the German Constitutional Court and the Treaty on Stability, Coordination and Governance in the Economic and Monetary Union, the Fiscal Compact.
