Property law in Classical roman Law - José Antonio González Romanillos

En el presente trabajo se realiza un análisis del derecho de propiedad en el Derecho romano clásico. En este sentido, el estudio se centra en los distintos tipos de propiedad que coexistían en época clásica, en los diferentes medios de adquirir la propiedad y en la protección procesal del propietario. Además, en el trabajo se hace también referencia a las distintas soluciones que han adoptado el BGB alemán y el Código civil español sobre ciertas cuestiones problemáticas relativas a la adquisición de la propiedad.
Die vorliegende Arbeit untersucht das Eigentum im klassischen römischen Recht. Hierbei konzentriert sie sich insbesondere auf die verschiedenen Eigentumsformen, die in klassischer Zeit nebeneinander bestanden, auf die verschiedenen Art des Eigentumerwerbs und auf den prozessualen Schutz des Eigentums. Darüber hinaus befasst sie sich auch mit den verschiedenen Lösungsansätzen, die das Bürgerliche Gesetzbuch (BGB) und der spanische Código civil im Hinblick auf bestimmte problematische Fragen des Eigentumserwerbs gefunden haben.

This paper analyzes the property rights in classical Roman law. The study focuses on the different types of property that coexisted; in the different means of acquiring the property and the owner's procedural protection. In addition, the paper also refers to the various solutions that the German BGB and the Spanish Civil Code have adopted on certain problematic issues concerning the acquisition of property.
