Power distribution and legal status of consumer associations in the Spanish autonomic State - José Gabriel Ruiz González

Las asociaciones de consumidores, además de ser una modalidad asociativa específica, son consagradas constitucionalmente como instrumentos para el ejercicio del derecho de participación de los consumidores. Esta doble condición determina que en su regulación tengan que participar tanto el Estado como las CCAA. Ahora bien, definir este reparto competencial resulta complejo. De un lado, el carácter de modalidad asociativa precisa que sea el Estado el que regule el núcleo esencial del derecho fundamental. De otro lado, conforme al sistema constitucional de reparto, ni la materia asociativa en general, ni la de asociaciones de consumidores en particular, son atribuidas ni al Estado ni a las CCAA. Por ello, en aplicación del principio dispositivo, algunas CCAA han asumido competencias diferentes en esta materia. Clarificar este reparto y determinar su alcance en la configuración de su estatuto jurídico son los objetivos fundamentales de este artículo.

Apart from being a specific form of association, consumer associations are constitutionally considered as instruments for the exercise of the right of consumer participation. This twofold condition implies the participation of both the State and the Autonomous Communities in the regulation of their legal status. The definition of the power distribution is, however, a complex task. On the one hand, this form of association requires the regulation, by the State, of the basic rights. On the other hand, under the constitutional system of power distribution, neither the associative subject-matter in general, nor the consumer association subjet-matter in particular, are attributed either to the State or to the Autonomous Communities. Therefore, pursuant to the dispositive principle, some Autonomous Communities have taken on different competences in this field. According to this, the purpose of the present paper is to clarify the distribution of powers and determine their impact on the shaping of their legal status.
