Jubilación forzosa y envejecimiento activo resultan conceptos difíciles de casar; a pesar de ello, hasta la Ley 3/2012, ambas nociones han coexistido en nuestro ordenamiento jurídico. El mantenimiento de la DA 10ª ET y, con él, la posibilidad de establecer cláusulas convencionales de retiro forzoso se presentaba como un obstáculo insoslayable, si lo que se ansiaba conseguir, en base al discurso imperante en la Unión Europea, era que las personas mayores permanecieran más tiempo en el mercado laboral para así hacer frente a las consecuencias del envejecimiento de la población. Por todo ello, conocer la respuesta de la negociación colectiva en este controvertido contexto, se presenta interesante, a la par que necesario, si lo que se persigue es profundizar en tan discutido asunto.

Compulsory retirement and active ageing are concepts difficult to match, nevertheless, up to the law 3/2012, both notions, they have coexisted in our legal system. The maintenance of the additional disposition 10 ª of the Statute of the Workers and, with him, the possibility of establishing conventional clauses of necessary retirement was appearing as an unavoidable obstacle, if what was longing to be obtained, on the basis of the commanding speech in the European Union, was that the major persons were remaining more time on the labor market this way to face to the consequences of the aging of the population. On the basis of the above conditions, knowing the negotiation outcomes performed in collective negotiation in this controversial scenario is as interesting as necessary, to deal with the problem in depth.
