On the voluntary jurisdiction in the spanish historical Law. - Juan Ramón Liébana Ortiz

En el presente trabajo se propone un recorrido por la regulación de la jurisdicción voluntaria en las diversas fases históricas que han terminado por conformar la legislación vigente en esta materia. Un análisis que, utilizando las aportaciones historiográficas al respecto, pretende aportar una nueva visión sobre la conformación histórica de esta institución jurídico-procesal; concluyéndose que la vigente regulación de la jurisdicción voluntaria es producto de la concepción medieval de esta institución jurídica.

This paper proposes a journey through the regulation of voluntary jurisdiction in the various historical phases that have come to shape the current legislation in this field of law. Using the historiographical contributions in this regards, this analysis seeks to provide new insights into the historical setting up of this institution; coming to the conclusion that nowadays’ voluntary jurisdiction regulation is a result of the mediaeval conception of this legal institution.
