Este artículo analiza la enorme trascendencia de la condición de los órganos jurisdiccionales de los Estados miembros como jueces ordinarios del ordenamiento jurídico de la Unión Europea para preservar el Derecho establecido por los Tratados a la luz del Dictamen 1/09, de 8 de marzo de 2011, en el que el Tribunal de Justicia hace énfasis también en la importancia de primer orden de la cooperación directa que establece el artículo 267 del Tratado de Funcionamiento de la Unión Europea entre el Tribunal mismo y las jurisdicciones nacionales para garantizar el cumplimiento efectivo del ordenamiento comunitario en los Estados miembros y la tutela judicial efectiva dentro de la Unión Europea. Como quiera que ambos principios se veían amenazados por la celebración del acuerdo constitutivo del Tribunal Comunitario y Europeo de Patentes entre la Unión Europea, sus Estados miembros y terceros sujetos internacionales, el Tribunal de Justicia se pronunció en contra del mismo en el dictamen.

This article analyzes the enormous significance of the task of the national jurisdictions, as ordinary courts within the European Union legal order, in order to preserve the law established by the Treaties in light of the Opinion 1/09, of 8 March 2011, where the Court of Justice also emphasizes the fundamental importance of direct cooperation that Article 267 of the Treaty on Functioning of European Union establishes between the Court itself and national jurisdictions to ensure the effective implementation of European Law in Member States and the effective judicial protection within the European Union. Since both principles were threatened with the celebration of the Agreement establishing the European and Community Patents Court by the European Union, its Member States and third international subjects, the Court of Justice ruled against it in its Opinion.
