More health reforms in France. - Alejandra Boto Álvarez

El sistema sanitario francés se encuentra en una evolución continua desde la aprobación, en 2009 de la Ley HPST y su posterior legislación de desarrollo. El sector evoluciona de forma tan vertiginosa que tan sólo dos años más tarde, la Ley ha sido profundamente renovada a través de la Ley 2011-940 aquí comentada. Con espíritu crítico y comparado, el objeto de esta crónica es el análisis del contenido efectivo de esta reforma, prestando especial atención a los distintos avatares de su tramitación parlamentaria, que dieron lugar a una grave sanción del texto aprobado en el Parlamento por el Consejo Constitucional.

French healthcare system lives a non-stop transition since Act 2009-879 regarding hospitals, patients, health and territory. Such piece of Law tried to incorporate efficiency into policymaking and to reduce geographical inequalities in access to care services and it has lead to a wide range of subsequent regulations. In fact, only in two years’ time, the Act itself has been amended by means of Act 2011-940, hereby commented. The aim of this paper is to analyse whether this reform will be able to lead to any sustainable change or to push French experience to be of relevance elsewhere in Europe and particularly in Spain. Special attention is paid to Constitutional Court’s harsh decision on the project, extremely wide and strict.
