Las reformas introducidas en la jubilación anticipada por la Ley 27/2010. (RI §411068)  


The reforms introduced in early retirement by the law 27/2011. - Daniel Toscani Giménez

En relación a la jubilación anticipada que se crea en 2002 la Ley 27/2011 ahora distingue entre la jubilación por crisis y la jubilación voluntaria. En ambos casos los requisitos de cotización son más exigentes, en correspondencia con el retraso en la edad ordinaria de jubilación a los 67 años y en la jubilación voluntaria. Sólo se mantiene la edad de 61 años para la jubilación anticipada por crisis, aumentándose a los 33 años cotizados para la voluntaria, al ponerse en relación con la nueva edad ordinaria de jubilación. La Ley 27/2011 modifica también los coeficientes reductores aplicables, que ahora se endurecen sobre todo al tener en cuenta el esfuerzo contributivo de forma limitada. La jubilación parcial experimenta un endurecimiento que la puede hacer inviable una vez transcurra el periodo transitorio de exigencia de nuevos requisitos de cotización.

In comparison with the early retirement created in 2002, the new regulation in the Law 27/2011 now distinguishes between a retirement due to crisis and a voluntary retirement. In both cases the requirements of contribution are greater in comparison with the increase of the ordinary age of retirement to 67 and the voluntary retirement. Only in the case of early retirement due to crisis the age of 61 is maintained, increasing to 33 years of contribution in the case of voluntary retirement. The Law 27/2011 also introduces changes in the decreasing coefficients, that now are more strict specially because they only take into account the contribution effort in a more limited manner. The partial retirement suffers greater requirements in the reform process which may make it unfeasible in the long run.
