El propósito de este trabajo es exponer las reflexiones sobre los supuestos de subcontratación de obras y servicios y derecho a la tutela judicial efectiva y a la huelga que pueden presentarse a la hora de activar el fenómeno de la descentralización productiva. El punto de partida será delimitar el ámbito de la descentralización productiva, para entender la subcontratación de obras y servicios. Seguidamente, se estudiará la subcontratación y la vulneración de los derechos a la tutela judicial efectiva y a la huelga de los trabajadores a consecuencia de la rescisión del contrato mercantil de arrendamiento de servicios por el empresario principal. Con ello se analizará el criterio que el Tribunal Constitucional mantiene al respecto, que ha traído polémica en su fallo al tener dos votos particulares.

The purpose of this paper is to present reflections on the case of subcontracting of works and services and the right to effective remedy and the strike that may occur when you activate the phenomenon of decentralization of production. The starting point will define the scope of the decentralization of production, to understand the subcontracting of works and services. Next, we will study the contract and violations of the rights to effective remedy and the strike by workers as a result of the termination of the commercial contract of lease of services by the principal employer. This will examine the criteria that the Constitutional Court upholds the respect that has brought controversy in its decision to have two separate opinions.
