The labour and trade unions committees. A hidden surprise of the 2010 labour reform - Luis Enrique de la Villa Gil

Quizá la más llamativa sorpresa escondida en la reforma laboral de 2010, sea la que posibilita la creación de unas Comisiones Laborales para canalizar la representación de los trabajadores en las empresas que no disponen de representantes legales de los trabajadores. Es, sin duda, una reacción contra la representatividad espontánea o a través de las asambleas, lo que es un último paso coincidente con los que se adoptaron en la transición a la democracia a causa del miedo que tales asambleas provocaban en el legislador. Pero lo importante no está en esas Comisiones de Trabajadores, sino en la opción de sustituirlas por Comisiones Sindicales más fuertes, que tendrán así, por esa vía, una oportunidad nunca prevista de estar presentes en las más pequeñas empresas, contribuyendo de ese modo a “sindicalizar” aún más la realidad social española. Un regalo del legislador que apenas han valorado los sindicatos, dedicados a protestar por la tibia modificación del reparto de poder en la empresa que ha intentado la reforma de 2010.

Maybe, the most remarkable hidden surprise of the 2010 labour reform is that there is an allowance for the creation of Labour Committees to channel workers' representation in small companies, those that due to its size are not entitled to legal workers' representation. It is a reaction against the spontaneous representation or the assembly representatives, without a doubt, a last coincident step with those which were adopted during the transition period towards democracy, because of the fear that such assemblies caused on the legislator. However, the outstanding ingredient is not within those Labour Committees, but in the option of replacing them for Committees of the stronger Trade Unions, that through this channel, will find an unprecedented opportunity to be represented in all businesses, this way contributing to "unionize" even more the actual Spanish society. A present from the legislator hardly appreciated and quieted by the Trade Unions, more focused on protesting about the slight changes made to the board of the company which has tried to implement the 2010 reform.
