Tackling the nineteenth-century legacy again: notes on current critical historiography of roman law. - Rafael Ramis Barceló

Este trabajo intenta explicar el desarrollo de la historiografía del Derecho Romano en los siglos XIX y XX. Defiendo que los conceptos y el lenguaje de Hegel no fueron asumidos críticamente por Ranke, Savigny y Mommsen, que separaron sus respectivas áreas de conocimiento (Historia, Derecho Público, Derecho Privado). Cuando Savigny puso el sistema del Derecho Romano en el BGB, los romanistas tuvieron dos caminos: a) ad intra, trabajar en las Facultades de Derecho separados de las Humanidades (y cooperando con los iusprivatistas); b) ad extra, con un trabajo interdisciplinar con los profesores de las Facultades de Humanidades. Resumo estas tendencias revisando la bibliografía más reciente (2005-2010). Concluyo que ambos caminos acaban con una crítica de los conceptos hegelianos y ambos superan la separación del Derecho romano de las otras áreas de conocimiento.

This paper tries to explain the development of the historiography of Roman Law in 19th and 20th centuries. I claim that the concepts and the language of Hegel were not critically assumed by Ranke, Savigny and Mommsen, which separated their respective areas of knowledge (History, Public Law, Private Law). When Savigny put the system of Roman Law into BGB, Romanists had two ways: a) ad intra, working at Law School separated from Humanities (and cooperating with Private Law scholars); b) ad extra, with an interdisciplinary work with scholars of Faculties of Humanities. I summarize these trends reviewing the current bibliography (2005-2010). I conclude that both ways finish with a critique of Hegelian concepts and both exceed the separation of Roman Law from the other areas of knowledge.
