(RI §409364)

The implementation of clauses about the minimum standard of rights protection: a new subsidiary function of legal comparison - Sabrina Ragone

The Author argues in favour of a new function of legal comparison and identifies it in the cases when it is necessary to apply the clauses regarding the level of rights protection. On the basis of an analysis of subsidiary functions of comparison, the Author focuses on the legal systems where various legal sources protect the same right and it is mandatory to solve specific cases on the basis of the regulation granting the strongest protection. Indeed, to identify the source that respects the abovementioned criterion, the judge is called upon to carry out a proper comparison, and in consequence the study of comparative method is essential.

I. PREMISE: OBJECTIVES AND REASONS FOR THE STUDY.- II. HOW DOES GLOBALIZATION AFFECT LEGAL COMPARISON?.- III. THE STRATIFIED REGULATION OF RIGHTS PROTECTION IN RELATION TO CLAUSES ABOUT THE MINIMUM LEVEL OF PROTECTION.- IV. SUBSIDIARY FUNCTIONS OF COMPARISON RELATED TO CASE LAW.- V.
