The implementation of clauses about the minimum standard of rights protection: a new subsidiary function of legal comparison - Sabrina Ragone

En el ensayo la autora elabora una nueva función práctica de la comparación jurídica y la individualiza en los supuestos de aplicación de las cláusulas relativas al nivel de protección de los derechos. Tras un análisis de las funciones subsidiarias de la comparación, se fija en los sistemas en los que coexisten más fuentes que regulan el mismo derecho y es obligatorio resolver el caso mediante la que comporta la mayor tutela. A estos efectos, para poder individualizar la norma que respete dicho criterio, el juez es llamado a realizar un verdadero estudio comparado, resultando para él fundamental el conocimiento de los aspectos metodológicos.

The Author argues in favour of a new function of legal comparison and identifies it in the cases when it is necessary to apply the clauses regarding the level of rights protection. On the basis of an analysis of subsidiary functions of comparison, the Author focuses on the legal systems where various legal sources protect the same right and it is mandatory to solve specific cases on the basis of the regulation granting the strongest protection. Indeed, to identify the source that respects the abovementioned criterion, the judge is called upon to carry out a proper comparison, and in consequence the study of comparative method is essential.
