Desde la aprobación de la nueva Constitución en diciembre de 1991, la doctrina del Derecho constitucional de Rumania con frecuencia se ha enfrentado a diversos retos. Entre los puntos que constantemente se cuestionaban se encontraba la forma en que ciertas relaciones sociales están reguladas, el modo de interpretación de las normas constitucionales, y en particular la práctica política y jurídica basada en la nueva ley fundamental. Antes de abordar las relaciones entre los poderes del Estado, algunos aspectos deben ser aclarados, como la inclusión del principio de separación de poderes en la Constitución de Rumania, así como su identificación. Argumentando que la regulación inicial de los poderes del Estado en 1991 se asentaba en el principio de separación, aunque este último no se expresó en estos términos hasta la revisión constitucional de 2003, debemos responder a la pregunta sobre la persistencia de la separación de los tres poderes. Esto no es tarea fácil, dado el hecho de que una parte importante en el proceso de control mutuo entre los poderes del Estado es interpretado por el Tribunal Constitucional, que no se ha establecido, -como un poder- en el art. 1º (párrafo. 4) de la Constitución. Una solución al problema de la identificación de los poderes del Estado en Rumania se propone abriendo el camino a un análisis de las relaciones entre ellos desde la aprobación de la Constitución. Estas relaciones fueron relativamente "débiles" durante 1992-1996 y 2000-2004; por el contrario fueron bastante convulsas durante el período 1996-2000, cuando varias cláusulas constitucionales fueron interpretadas de forma divergente, y ejecutadas por la Presidencia y el Gobierno -especialmente entre 2004 y 2009-. Durante este intervalo, había no sólo casos de interpretación y aplicación contradictoria por diversas autoridades públicas de determinadas normas constitucionales que regulan las relaciones entre los poderes del Estado, sino también situaciones en las que dichas normas fueron ignoradas y discutidas, llevando a callejones sin una salida institucional. En tales circunstancias, se incrementó el papel del Tribunal Constitucional dando lugar a varias polémicas políticas, así como debates doctrinales. Naturalmente, una serie de propuestas de revisión de la Constitución de Rumania han surgido en este contexto, habiéndose iniciado ya el proceso.

Since the adoption of the new Constitution in December 1991, the science of Romanian Constitutional Law has often faced challenges. Among the points that have frequently been questioned are: the manner in which certain social relations are regulated, the mode of interpretation of the constitutional norms and particularly the political and legal practice grounded in the new fundamental law. Prior to addressing the relations among state powers, certain aspects must be clarified, such as the inclusion of the principle of separation of powers in the Romanian Constitution, as well as their identification. Arguing that the initial regulation of state powers in 1991 was grounded in the separation principle, although the latter was not expressed in terminis until the 2003 constitutional revision, we must answer a question about the persistence of the trinity of powers. This is not an easy task, given the fact that a significant part in the process of mutual control among state powers is played by the Constitutional Court, which is not stipulated –as a power – in art. 1 (par. 4) of the Constitution. A solution to the problem of identifying state powers in Romania is proposed, opening the way to an analysis of the relations among them since the adoption of the Constitution. These relations were relatively “smooth” during 1992-1996 and 2000-2004; on the other hand, they were quite turbulent during 1996-2000 -when several constitutional clauses were divergently interpreted and implemented by the Presidency and the Government- and especially between 2004 and 2009. During this interval, there were not only cases of contradictory interpretation and implementation by various public authorities of certain constitutional norms regulating the relations among state powers, but also situations in which such norms were ignored and contested, leading to institutional deadlocks. In such circumstances, the role of the Constitutional Court immensely increased, leading to several contentious political, as well as doctrinal debates. Naturally, a number of proposals for a revision of the Romanian Constitution have emerged in this context, and the process has already been initiated.
