El presente trabajo analiza los efectos que produce la conducta dolosa de comprador y vendedor en la regulación clásica de la venditio rei alienae, sobre todo en lo que se refiere al cumplimiento del habere licere del vendedor y las posibilidades de defensa concedidas al comprador.

The present work studies the effects that there produces the fraudulent conduct of buyer and seller in the classic regulation of the venditio rei alienae. The investigation is centred specially on the fulfillment of the habere licere of the seller and the possibilities of defense granted to the emptor.
