Religious marriages and socio-legal aspects of the crime of bigamy - Alberto Panizo y Romo de Arce

El trabajo ofrece una visión ampliamente documentada del desarrollo que ha registrado en España la tipificación del delito de bigamia. Comienza con un estudio histórico, para centrarse en la actual normativa del Código Penal de 1995, llevando a cabo un análisis de los problemas que plantea la irrupción en nuestro país de otras tipologías religiosas acatólicas, y la consideración que tales uniones tienen en relación con los elementos conformadores del citado tipo penal.

The paper offers a widely documented vision on the development that the statute offence of bigamy has undergone in Spain. The paper starts with a historical study, then it focuses on the 1995 Criminal Code provisions and analyses the problems stemming from the arrival in Spain of other religious faiths different from the Catholic, as well as the meaning those marital relationships have regarding the elements that make up the above-mentioned offence.
