The Reform of the regulations of nationals of non-eu member countries - Concha Aprell Lasagabaster

El trabajo tiene como objeto el estudio de las reformas introducidas en la regulación de la residencia de los familiares de nacionales de la Unión Europea y del Espacio Económico Europeo, así como las introducidas en el Reglamento de Extranjería dirigidas a facilitar el nuevo reparto de competencias entre el Estado y las Comunidades Autónomas en materia de autorizaciones iniciales de trabajo y a paliar las consecuencias de la “irregularidad sobrevenida” de los inmigrantes.

I.- EL REAL DECRETO 1161/2009, DE 10 DE JULIO, POR EL QUE SE MODIFICA EL APARTADO 2 DEL ARTÍCULO 4 DEL REAL DECRETO 240/2007, DE 16 DE FEBRERO, SOBRE ENTRADA, LIBRE CIRCULACIÓN Y RESIDENCIA EN ESPAÑA DE CIUDADANOS DE LOS ESTADOS MIEMBROS DE LA U.E. Y DE OTROS ESTADOS PARTE EN EL ACUERDO SOBRE EL ESPACIO ECONÓMICO EUROPEO.- II.- EL REAL DECRETO 1162/ 2009, DE 10 DE JULIO, POR EL QUE SE MODIFICA EL REGLAMENTO DE LA LEY ORGANICA 4/2000, DE 11 DE ENERO, SOBRE DERECHOS Y LIBERTADES DE LOS EXTRANJEROS EN ESPAÑA Y SU INTEGRACIÓN SOCIAL, APROBADO POR EL REAL DECRETO 2392/2004, DE 30 DE DICIEMBRE. 1.- La autorización inicial de residencia y trabajo en los supuestos que intervengan la Administración General del Estado y la Administración Autonómica correspondiente. 1.1. Los aspectos más relevantes del procedimiento. 1.2. la gestión electrónica del procedimiento. 2. La “irregularidad sobrevenida”. 3. A modo de conclusión.

The work aims to study reforms in the regulation of the family residence of nationals of the European Union and European Economic Area, as well as those introduced in the Immigration Rules to facilitate the new distribution of powers between the State and the Autonomous Communities in terms of initial work permits and to alleviate the consequences of "ensuing illegality" of immigrants.

I. - THE ROYAL DECREE 1161/2009, OF 10 JULY, BY AMENDING SECTION 2 OF ARTICLE 4 OF THE ROYAL DECREE 240/2007 OF FEBRUARY 16, ON ENTRY, FREE MOVEMENT AND RESIDENCE OF CITIZENS IN SPAIN THE EU MEMBER STATES AND OTHER STATES PARTIES TO THE AGREEMENT ON THE EUROPEAN ECONOMIC AREA .- II .- THE ROYAL DECREE 1162 / 2009, dated 10 July, BY AMENDING THE RULES OF THE ORGANIC LAW 4 / 2000 of 11 January, ON RIGHTS AND FREEDOMS OF FOREIGNERS IN SPAIN AND SOCIAL INTEGRATION, approved by Royal Decree 2392/2004, of 30 December.- 1.- The initial authorization to reside and work in cases involving the General State Administration and the Autonomous Administration concerned. 1.1.
