Legal residence as a condition of access to social security protection of aliens outside - Nancy Sirvent Hernández

El derecho a Seguridad Social de los extranjeros no comunitarios sigue siendo todavía una cuestión no resuelta definitivamente por el legislador español. La falta de precisión que presenta la normativa que se ocupa de esta materia ha propiciado la defensa de tesis muy distintas entre la doctrina científica y la jurisprudencia. No obstante, éste es un tema en el que no cabe alcanzar una conclusión única, válida para todas las hipótesis, sino que permanece abierto a diferentes soluciones en función de las dispares situaciones en las que puede encontrarse el extranjero (con permiso de trabajo y residencia, estando en posesión tan sólo de alguno de ellos, o careciendo de ambos) y del origen profesional o común de la contingencia (por aplicación de la Normativa internacional). El presente estudio tiene por objeto analizar todo ese elenco de situaciones y soluciones que se pueden dar en orden a acceder a las prestaciones y servicios de Seguridad Social por parte de los inmigrantes.

The right to social security of the non-EU still remains an unresolved issue definitively by the Spanish legislature. The lack of precision introduced legislation that addresses this issue has prompted the defense between different scientific doctrine and jurisprudence. However, this is an issue that can not reach a single, valid for all scenarios, but remains open to different solutions depending on different situations in which the alien may be found (with work permits and residence being in possession of only one of them, or lack thereof) and the origin of the common professional or contingency (for application of international standards). This study aims to analyze the range of situations and solutions that can be taken in order to access benefits and social security services by immigrants.
